Archer Community - Terms & Conditions

General: Archer Technologies LLC views the use of the Archer Community as a privilege. Archer Technologies LLC has established the following Terms and Conditions to govern the Archer Community and to ensure an understanding of the limitations and risk associated with its use.

Archer Technologies LLC and Archer Community visitors and members acknowledge that the Archer Community will evolve over time in ways that cannot be predicted. Therefore, Archer Technologies LLC reserves the right to modify the Terms and Conditions at any time, without notice and at its sole discretion.

Any violation of these Terms could result in legal action or the limitation, suspension or termination of privileges to use the Archer Community in whole or in part.

Intended Users: Archer Technologies LLC provides certain Archer Community service to all visitors. However, some functionality and content of the Archer Community is reserved specifically for current customers and partners. Establishing yourself as an Archer Community visitor or member does not create a partnership or employment relationship between you and Archer Technologies LLC.

Member Identification: Archer Community members agree to provide accurate information identifying themselves. They agree not to impersonate other individuals and will not share their account. Members will be able to create a professional (non-offensive), unique alias screen name (user name) in the event they do not want to use their full name when contributing to the Archer Community.

Community Purpose: Archer Community visitors and members shall use the social networking forum for the sole purpose of facilitating and promoting communication related to events, products, services and relevant information to assist and enhance the value of the Archer Technologies product suite only. Archer Community visitors and members shall:

Agree to understand and abide by common courtesy and etiquette of an online community.
Agree not to use the Archer Community for the creation or delivery of unsolicited communication (e.g., SPAM, sale of services, advertisements, etc.)
Agree not to attempt to circumvent, ”hack” or otherwise compromise the Archer Community.
Agree not to utilize the Archer Community for commercial or profit-making purposes.

Views & Opinions: Archer Technologies LLC shall not be treated as the publisher of any information provided by an Archer Community member. The views expressed by Archer Community members do not necessarily reflect the views of Archer Technologies LLC or its management. Comments or opinions expressed within the Archer Community are solely those of the respective contributor. The Archer Community member that contributed the content agrees to hold Archer Technologies LLC harmless from and against any claims, losses or liabilities of such contributions.

Content Contribution: By contributing content, the Archer Community member agrees that all content, including ideas, become the intellectual property of Archer Technologies LLC. The Archer Community member agrees and provides express consent to release all rights, including but not limited to monetary rights and copyright to content, and acknowledges that the content may be reused by Archer Technologies LLC or quoted in other media and may or may not be attributed to the Archer Community member by name.

The Archer Community member understands and agrees that the information contributed to the Archer Community may be visible to all visitors of the Archer Community at the sole discretion of Archer Technologies LLC. While some controls exist that allow Archer Community members to restrict access to some information, Archer Technologies LLC makes no warranties about the function of these controls and cannot be held liable should these controls fail.

Furthermore, Archer Community members agree that it is their sole responsibility to ensure that their contribution adheres to all legal and best practices including and not limited to:

Accuracy: All contributions shall not contain information, intentionally or unintentionally, that is false or misleads any visitors or members of the Archer Community
Legal: All contributions shall not contain information that violates any applicable law.
Harassment: All contributions shall not contain any material that is obscene, defamatory, profane, threatening, harassing, abusive, hateful, embarrassing to another person or entity, or violates the privacy rights of another.
Electronic Threats: All contributions shall not contain viruses, Trojan horses, worms, or any other computer code that is intended, intentionally or unintentionally, to damage, interfere with, or surreptitiously intercept or expropriate any system, data, or information.
Solicitation: All contributions shall not contain any form of advertisement or solicitation. Any reference to sales of service or products (advertisements) for any product or service other then Archer Technologies services or products is strictly prohibited.
Proprietary, Confidential and Intellectual Property: All contributions shall not compromise trade secrets, contain confidential information, or violate copyright or other intellectual property rights.
Copyright Material: All contributions shall not contain copyright material unless (a) the contributor is the copyright owner, or (b) the contributor has written permission from the copyright owner to contribute the copyrighted material.

In all cases, the Archer Community member that contributed the content agrees to defend themselves and hold Archer Technologies LLC harmless from and against any claims, losses or liabilities of such contributions or disclosers.

Content Review: In general, Archer Technologies LLC will not review content prior to a Community posting yet will make reasonable efforts to monitor Archer Community content for abuse or violation of these Terms and Conditions. Archer Technologies LLC is solely responsible for defining reasonable effort.

Archer Technologies LLC reserves the right to remove content or exercise editorial control over posted content but has no commitment to do so. Archer Technologies LLC can post content in its entirety, in an edited version, or not at all. Editing or removal of content will be done primarily for unlawful, offensive, threatening, slanderous, obscene, unprofessional or off-topic subject matter or violation of these Terms and Conditions. Every effort will be made to review and take appropriate action, within a reasonable timeframe, once questionable content is identified and Archer Technologies LLC is notified. Archer Technologies LLC is solely responsible for defining a reasonable timeframe.

Liability of Content Use: Archer Community visitors and members acknowledge that content is provided by third parties who are solely responsible for such content regardless if reviewed or moderated by Archer Technologies LLC. Archer Community visitors and members agree that Archer Technologies LLC and its employees are not responsible and disclaim any and all liability for the content within the Archer Community. Archer Community visitors and members assume full responsibility and liability for all risk, decisions or actions arising from the use of content from the Archer Community, including and not limited to:

Content Accuracy: Archer Technologies LLC cannot and does not guarantee the accuracy, relevance, timeliness or completeness of the information contributed by Archer Community members. An effort to correct all errors will be made if notified through the proper channels yet is not guaranteed.
External Content: Archer Technologies LLC does not assume responsibility, nor can it be held accountable for the contents or practices of external resources that Archer Community members may reference or link to within the content they contribute within the Archer Community. Archer Technologies LLC therefore does not assume responsibility for such content.
Electronic Threats: Archer Technologies LLC cannot and does not guarantee content obtained from the Archer Community to be free of viruses, Trojan horses, worms, or any other computer code that is intended, intentionally or unintentionally, to damage, interfere with, or surreptitiously intercept or expropriate any system, data, or information. Archer Technologies LLC therefore does not assume responsibility for such risk. Archer Community visitors and members agree to assume all risk associated with obtaining content and have sole responsibility to scan and verify the integrity of the content prior to use.

Subscriptions (RSS Feeds & Email): Archer Community members acknowledge that Archer Technologies reserves the right to discontinue RSS (really simple syndication) feeds or email notification services provided by the Archer Community at any time without notice. These subscriptions are intended for non-commercial use for Archer Community members only. Any other use is strictly prohibited without prior written consent from Archer Technologies LLC.

Content provided through the various subscriptions is provided with limitations as outlined within these Terms and Conditions and must be utilized:

As provided and shall not be edited or modified in any way
In a manner that directly links to and credits Archer Technologies LLC and the Archer Community.

Right to Change: Archer Technologies LLC reserves the right to change the nature, functionality, content, services or Terms and Conditions for the Archer Community at any time at its sole discretion. It is the responsibility of the Archer Community visitor or member to frequently review and adhere to the current Terms and Conditions.

Legal Action:

Governing Law: Archer Technologies LLC and Archer Community visitors and members agree that all matters related to the Archer Community or these Terms and Conditions shall be governed by, and construed and enforced in the accordance with, the laws of the State of Kansas.
Attorney Fees: Archer Community visitors and members agree that they are solely responsible for reasonable attorneys fees incurred by Archer Technologies LLC or its employees as a result from any legal action associated with their activity related to the use of the Archer Community.

Acceptance: These terms constitute the entire agreement between you and Archer Technologies LLC. They supersede all prior agreements, proposals or representations, written or oral, concerning its subject matter. By visiting the Archer Community, you acknowledge that you have read and accepted these Terms and Conditions. Furthermore, by registering or authenticating onto the Archer Community, you acknowledge that you are a current customer or partner of Archer Technologies LLC and you have read and accepted these Terms and Conditions.
